Objectives
ROOTS AND EVOLUTION OF ENGLISH LAW, THE BIRTH OF U.S. LAW AND AUTONOMY BY ENGLISH LAW; VALENCE OF THE SOURCE OF CASE LAW, THE RELATIONSHIP BETWEEN FEDERAL AND STATE JUDICIAL SYSTEM, AND THE ANALYSIS OF CONTRACT, TRUST AND CLASS ACTION.
Prerequisites
KNOWLEDGE OF THE ITALIAN SYSTEM AND EVEN ELEMENTARY KNOWLEDGE OF ENGLISH.

THIS TEACHING IS INTENDED TO GIVE STUDENTS: ACQUISITION OF THE FUNDAMENTAL CONCEPTS AND INSTITUTES MOST CHARACTERISTIC OF ENGLISH LAW AND UNITED STATES LAW AND THE KNOWLEDGE OF THE DIFFERENT ORGANS OF LEGAL POWER, ACQUIRING THE ABILITY TO GRASP THE DIFFERENCES AND POSSIBLE CONVERGENCES WITH THE ITALIAN LEGAL SYSTEM;
ABILITY TO INTERPRET A LEGISLATIVE TEXT BE IT U.S. OR ANGLO SAXON, AS WELL AS ABILITY TO DISCERN THE PARTS OF AN ENGLISH OR U.S. JUDGMENT, UNDERSTANDING THE PECULIARITIES OF THE U.S. FEDERAL LAW;
ABILITY TO OFFER DIFFERENT INTERPRETATIONS OF LEGAL ISSUES OF GREAT RELEVANCE, IN PARTICULAR THOSE DEVELOPED FROM U.S. LAW, PROVIDING LEGAL SOLUTIONS, THAT CONSIDER THE HISTORICAL PECULIARITIES OF THE ANGLO-AMERICAN LAW; ABILITY TO PERFORM TO AN AUDIENCE, EVEN TO NON SPECIALISTS, A DISCUSSION OF THE ISSUES THAT CONCERN THE ENGLISH LAW AND U.S. LAW, HOLLOWING OUT THE LEGAL REASONING THAT JUSTIFIES THE CHOICE OF A GIVEN LEGAL INTERPRETATION;
ACQUIRE THE METHOD AND THE TOOLS NEEDS TO STUDY INDEPENDENTLY AND ORGANIZED THE THEMES OF ANGLO-AMERICAN LAW.
Teaching Methods
THE COURSE CONSISTS OF 72 HOURS OF LESSONS, SOME WITH A SEMINAR, OR WITH READING LEGISLATION AND COURT RULINGS.
Verification of learning
THE COURSE IS DESIGNED FOR STUDENTS WHO REGULARLY ATTEND.
STUDENTS ATTENDING THE COURSE:
FINAL ORAL EXAMINATION THAT TAKES INTO ACCOUNT THE ACTIVE PARTICIPATION TO LECTURES AND CONTEXTUAL READING OF EDUCATIONAL MATERIALS DISTRIBUTED. DURING THE LAST WEEK OF THE COURSE STUDENTS WHO HAVE FOLLOWED THE COURSE CAN CHOOSE TO SUPPORT A TEST ORAL OR WRITTEN PART THAT WILL BE WORTH FOR THE EVALUATION OF THE EXAMINATION.
STUDENTS NOT ATTENDING
FINAL EXAMINATION.
EVALUATION CRITERIA EXAMINATION:
1) ABILITY TO ARTICULATE A DISCOURSE
2) THE ABILITY TO EXPRESS YOURSELF CLEARLY AND WITH APPROPRIATE LANGUAGE
3) SHOW CLEARLY IN THE KNOWLEDGE OF THE DIFFERENCES AND THE SIMILARITIES BETWEEN THE ENGLISH LAW AND U.S. LAW.
