THE COURSE HAS THE AIM TO PROVIDE USEFUL INSTRUMENTS FOR THE ANALYSIS AND THE COMPREHENSION OF LEGAL-PHILOSOPHICAL REFLECTION. THE MOST IMPORTANT LEGAL THEORIES OF THE NINETEENTH AND OF THE TWENTIETH CENTURY WILL BE EXAMINED. THE KEY PROBLEMS OF CONTEMPORARY DEMOCRACIES WILL BE ANALYZED. - KNOWLEDGE AND UNDERSTANDING ABILITY GENERAL KNOWLEDGE OF THE MAIN PHILOSOPHICAL-LEGAL CATEGORIES THROUGH THE ANALYSIS OF CLASSICAL TEXTS OF THE LEGAL AND PHILOSOPHICAL THOUGHT; DEEPENING UNDERSTANDING OF THE INSTITUTIONAL, POLITICAL, SOCIAL AND ECONOMIC DYNAMICS OF THE CONTEMPORARY DEMOCRACIES. - ABILITY TO APPLY KNOWLEDGE AND UNDERSTANDING ABILITY TO ANALYZE THE PROBLEMS RELATED TO THE RADICAL CRISIS OF THE DEMOCRACIES. - JUDGMENT AUTONOMY CAPACITY OF RECEPTING AND INTERPRETING AUTONOMLY DATA AND SIMPLE AND COMPLEX INFORMATION RELATED TO THE SCIENTIFIC FIELD OF THE PHILOSOPHY OF LAW. - COMMUNICATION SKILLS ABILITY TO EXPOSE IDEAS, ANALYSIS, PHILOSOPHICAL-LEGAL THEORIES, DEMONSTRATING AN ADEQUATE LEVEL OF TECHNICAL LANGUAGE. -LEARNING ABILITY ACQUISITION OF THE ABILITY TO USE IN ANY ORIGINAL WAY THE PHILOSOPHICAL-LEGAL COMPETENCES ACQUIRED |

THE COURSE LOOKS AT THE PROBLEM OF DEFINITION OF LAW. IS LAW A FACT OR A QUALIFICATION OF A FACT? IS IT A SEIN OR A SOLLEN? IN WHAT DOES THE VALIDITY AND EFFECTIVENESS OF LAW CONSIST? WHAT RELATION EXISTS BETWEEN VALIDITY AND VALUE OF LAW? IN ORDER TO GIVE AN ANSWER TO THESE QUESTIONS, WILL BE COMPARED GIUSNATURALIST AND GIUSPOSITIVIST THEORIES. THE SPECIAL PART EXAMINES THE CRISIS OF CONTEMPORARY DEMOCRACY AND THE CONCEPT OF POWER. |

ORAL EXAMINATION (MINIMUM 3 QUESTIONS) AT THE END OF THE COURSE, AIMED TO ASSESS KNOWLEDGE AND UNDERSTANDING OF COURSE CONTENTS AND THE ABILITY OF APPLYING THEM. GRADING SYSTEM: 30-POINT SCALE - MINIMUM PASSING GRADE: 18/30 = SUFFICIENT KNOWLEDGE OF COURSE CONTENTS AND LOW ABILITY TO USE THEM IN A STUDY ENVIRONMENT; - BEST GRADE: 30/30 = FULL KNOWLEDGE OF COURSE CONTENT AND HIGH ABILITY TO USE THEM IN A STUDY ENVIRONMENT;. FINAL GRADE IS TO BE MEANT AS AVERAGE OF GRADES RESULTING FROM EVERY ANSWER TO QUESTIONS. MIDTERM TEST IS JUST FOR ATTENDING STUDENTS. |
