Workshop: International Organizations as Law-Makers

The term international organization today tends to denote a variety of forms of cooperation among States. The existence of other types and formats of relationships between groups of States, and between States and other entities, has led to considering this terminology as either a mere genus, a flexible conceptual category, or conversely, a notion limited to international organizations established by treaties and having a legal personality. While attaining a univocal normative definition is difficult (the more overarching definition contained in DARIO is not applicable erga omnes), scholars have highlighted some common constitutive elements and principles in relation to international institutional law. Such law has very broad connotations that elude a precise framework in a given legal order and could thus be considered the product of a multiplicity of public and private actors operating in international and transnational relationships. Adopting a multidisciplinary approach, this workshop intends to distinguish the law-making and governance characteristics of such international institutional law in general, and with specific reference to some international organizations or other intergovernmental bodies and private actors.
